IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THESE TERMS AND CONDITIONS BEFORE PROCEEDING WITH THIS TRANSACTION. IF THERE IS ANY TERM THAT YOU DO NOT UNDERSTAND OR DO NOT WISH TO AGREE TO, PLEASE DISCUSS IT WITH A REPRESENTATIVE OF NEWEL LLC (“NEWEL”). ONLY PROCEED WITH THIS TRANSACTION IF YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS SET OUT BELOW.

1. Purpose and Effect
The following terms and conditions set out all the terms of agreement, other than price, between you (the buyer) and Newel LLC (the seller) in relation to the sale and purchase of the item(s) identified in the invoice (referred to as the “work”). We confirm that we either own the work or are authorized to sell it on behalf of the owner. Any variation or addition to these terms and conditions must be agreed to in writing by Newel LLC.
2. Statements About the Work
2.1. All items are sold AS IS. Any and all statements by Newel LLC regarding the authenticity, attribution, description, date, age, provenance, title, or condition of the work constitute our judgment and opinion only and are not warranted. We do not accept any liability for any changes in expert opinion post-sale, except for cases of fraudulent misrepresentation.
2.2. Newel LLC does not warrant and is not authorized to certify UL Laboratory compliance for any item.
2.3. While we will, upon request, explain the condition of the work and provide any reasonable information, we are not responsible for any subsequent deterioration of the work after the sale.
2.4. Buyers are responsible for satisfying themselves about statements made by Newel LLC regarding the matters outlined above.
3. Shipping Information
Packing, handling, and shipping of purchased lots are the sole responsibility of the purchaser. Newel LLC does not provide packing or shipping services but recommends the following independent shippers. Newel LLC receives no compensation for shipping referrals. We strongly urge purchasers to obtain shipping insurance and more than one shipping quote.

4. Payment
ALL SALES ARE FINAL!
Accepted payment methods include Visa, MasterCard, American Express, Discover, and Wire Transfer. Payments must be completed within five days of the auction's end for Internet bidders and within one hour for in-person bidders. Credit card payments can be made online or by phone at 718-395-1955.
All credit card purchases are subject to a 3% fee.
Total due if paid by credit card: All Purchases Subject to "Terms and Conditions of Sale."
We do not accept personal checks or PayPal under any circumstances.
5. Condition of Items
All lots are sold AS IS, WHERE IS. No statements made regarding the age, condition, value, or quality of any lot, whether made orally or in writing, shall be construed as a warranty, either express or implied. Newel LLC does not offer refunds based on condition. It is the purchaser's responsibility to inspect items or request additional condition reports before bidding.
6. Bidding
All bidders must be pre-registered and approved by Newel LLC. Bidders may bid in person, by absentee bid, or via the Internet. Newel LLC is not responsible for failure to execute absentee bids or for electronic failures, including those caused by third-party platforms (e.g., LiveAuctioneers). Auctioneers reserve the right to reject any bids. Lots are sold to the highest bidder as determined by the auctioneer. Internet bidders should register at least two hours before the auction.

7. Buyer's Premium
A buyer’s premium of 18% applies to successful in-person bids. For Internet bids, a buyer’s premium of 23% will be added to the successful bid price. State and local sales taxes will apply to all purchases unless the purchaser provides proof of exemption.
8. Indemnification
Buyers agree to indemnify and hold Newel LLC harmless from any claims, damages, or liabilities resulting from any issues arising from third-party auction platforms, including but not limited to LiveAuctioneers. Newel LLC is not responsible for errors, failures, or disruptions of third-party auction platforms.
9. Removal of Property
All property must be removed at the purchaser's expense by 5:00 PM on the Monday following the sale date for in-person purchases. Internet purchases must be picked up within 10 days of the auction. If property is not removed within the specified time, a storage fee of $25.00 per lot per day will apply. After 30 days, Newel LLC reserves the right to sell the property at auction without further notice, with proceeds retained as storage fees. Title transfers at the conclusion of the auction, and any damage, loss, or theft after the auction ends will be at the buyer's expense.

The auctioneer reserves the right to reject bids, determine bidding increments, and resolve disputes at their sole discretion. All auction sales are final.
The buyer is solely responsible for ensuring that purchased items comply with all local, state, federal, and international laws regarding transport. This includes the legality of transporting materials such as ivory, tortoiseshell, or other endangered species. The buyer is responsible for obtaining any necessary documentation, including but not limited to CITES permits, for items containing endangered species. Newel LLC is not responsible for obtaining these permits or for any delays related to the failure to secure proper documentation.
12. Copyright
The buyer is solely responsible for ensuring that purchased items comply with all local, state, federal, and international laws regarding transport. This includes the legality of transporting materials such as ivory, tortoiseshell, or other endangered species. The buyer is responsible for obtaining any necessary documentation, including but not limited to CITES permits, for items containing endangered species. Newel LLC is not responsible for obtaining these permits or for any delays related to the failure to secure proper documentation.
13. Miscellaneous
13.1 These terms and conditions bind and inure to the benefit of the parties' assigns, successors, trustees, heirs, executors, and administrators.
13.2 Neither Newel LLC nor the buyer's failure to insist upon strict performance of any provision of these terms shall be deemed a waiver of any rights.
13.3 This transaction is governed by the laws of the State of New York. Any legal proceedings must be conducted in New York County.
13.4 The invalidity of any portion of these terms and conditions shall not affect the remainder.
IMPORTANT: Please read and understand these Terms and Conditions before participating in any transaction. If you do not agree with any term, discuss it with a representative of Newel LLC ("Newel") before proceeding. Participation in the auction constitutes full acceptance of these Terms and Conditions.

1. Purpose and Effect
These Terms and Conditions form the agreement—other than price—between you ("Buyer") and Newel LLC ("Seller") regarding the sale and purchase of the item(s) identified on the invoice ("Work").
Newel represents that it either owns the Work or is authorized to sell it on behalf of the owner. Any modification to these Terms and Conditions must be made in writing and approved by Newel.
2. Statements About the Work
All items are sold AS IS.
Any statement regarding authenticity, attribution, description, date, age, provenance, title, origin, or condition reflects Newel's opinion only and shall not be deemed a warranty or representation of fact.
Newel shall not be liable for changes in expert opinion occurring after the sale, except in cases of fraudulent misrepresentation.
Newel does not warrant or certify compliance with UL (Underwriters Laboratories) standards.
Upon request, Newel will provide available condition information; however, Newel is not responsible for any deterioration occurring after the sale.
Buyers are solely responsible for satisfying themselves as to the nature, condition, and value of any property offered for sale.
3. Registration & Identification
All Buyers must register prior to bidding and provide valid government-issued photo identification.
A bank reference may be required to establish or increase bidding limits.
Pickup Requirements
Buyers or their authorized agents must present valid government-issued photo identification at pickup.
For third-party pickups, Buyers must provide written authorization and a copy of the Buyer's photo identification to Newel in advance.
Property will not be released until payment has been received in full and all funds have cleared.
Buyers must comply with Newel's Pickup & Loading Dock Procedures.
Failure to comply may result in delays or refusal of release.
Buyer consents to Newel photographing or recording the pickup and release of purchased property for security, verification, and record-keeping purposes.

The cardholder name must match the registered bidder name.
Newel reserves the right to require payment by wire transfer for any transaction.
Personal checks and PayPal are not accepted.
Buyer agrees that all sales are final and waives any right to initiate a credit card chargeback based on authenticity, condition, or description disputes.
If fraudulent activity is suspected, Newel may cancel the transaction and resell the lot.
No property shall be released until all funds have fully cleared Newel's account.
5. Condition of Items
All lots are sold AS IS, WHERE IS.
No oral or written statement regarding age, condition, value, quality, or rarity shall constitute a warranty.
No refunds will be issued for condition-related concerns.
Buyers are encouraged to inspect property in person or request condition reports prior to bidding.

Newel is not responsible for failure to execute absentee bids or for technical failures involving internet service providers or third-party bidding platforms, including LiveAuctioneers.
The Auctioneer reserves the right to reject any bid and shall determine the successful bidder.
7. Buyer's Premium
Please check the online catalog to see the applicable buyers premium rate.
Applicable sales tax will be charged unless a valid exemption certificate is provided prior to payment.
8. Removal of Property
Pickup Deadlines

In-person purchases: Must be removed by 5:00 PM on the Monday following the sale.

Internet purchases: Must be picked up within ten (10) days of the auction.
Storage Fees
A storage fee of $5.00 per lot, per day, will be charged after the applicable removal deadline.
Property remaining after thirty (30) days may, at Newel's discretion, be re-auctioned or otherwise disposed of, with proceeds applied toward storage and related charges.
Title and risk of loss pass to the Buyer at the conclusion of the auction.
9. Indemnification
Buyer agrees to indemnify, defend, and hold harmless Newel LLC from any claims, damages, liabilities, costs, or expenses arising from participation through third-party auction platforms, including LiveAuctioneers.
10. Buyer Responsibility for Legal Transport & CITES Compliance
Buyer is solely responsible for ensuring compliance with all local, state, federal, and international laws governing ownership, transport, export, and import of purchased property.
This includes obtaining any required permits, licenses, or documentation relating to ivory, tortoiseshell, endangered species materials, and other regulated goods.
Newel will not obtain permits on behalf of Buyers and shall not be liable for delays, denials, seizures, or penalties resulting from noncompliance.
11. Auctioneer's Discretion
The Auctioneer reserves the right to:

Reject any bid

Establish bidding increments

Resolve bidding disputes

Withdraw lots from sale
All determinations made by the Auctioneer shall be final.
12. Copyright
All catalog text, photographs, images, and related materials are the property of Newel LLC and may not be reproduced, distributed, or used without prior written consent.
All copyrights remain the property of Newel LLC.
13. Non-Payment & Default
If the Buyer fails to pay in full within the required timeframe, Newel may:

Cancel the sale

Retain any deposit
-
Resell the property
The defaulting Buyer shall be responsible for any deficiency, collection costs, attorney's fees, and other damages incurred by Newel.
14. Dispute Resolution & Recovery of Legal Costs
In any action arising from or relating to these Terms and Conditions, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and related expenses from the non-prevailing party.
15. Online Bidding Disclaimer
Newel LLC shall not be responsible for errors, delays, interruptions, internet failures, or platform malfunctions that prevent bids from being placed, transmitted, or acknowledged.
The Auctioneer's records shall be final and conclusive in all respects.
16. Acceptance of Terms
By registering to bid, placing a bid, or completing a purchase, the Buyer acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
17. Taxes & Required Documentation
All purchases are subject to applicable state and local sales taxes unless the Buyer provides a valid resale certificate or other acceptable proof of exemption before payment.
Out-of-state deliveries may qualify for exemption where supported by a Bill of Lading from a licensed common carrier showing delivery outside New York State.
Buyers claiming exemption status must provide all required documentation prior to payment.
If the necessary documentation is not provided before payment is made, sales tax will be collected and will not be refunded.
Newel LLC reserves the right to verify the validity of all resale and exemption certificates.
SHIPPING INFORMATION
